LIMITED WARRANTY

Thank you for choosing Chilo Plunges ( “Company” or “we” or “us”) for your cold plunge needs. We take pride in offering high-quality products designed to enhance your wellness experience. This warranty document outlines the terms and conditions under which we offer coverage for your Plunge ("the Product").

Chilo Plunges warrants from the date of installation to the original consumer purchaser ("you") the following when your Plunge is purchased from the Company.

WARRANTY COVERAGE

  1. Structure: Chilo Plunges offers a five-year warranty on the structural integrity of the wood utilized in your cold plunge, provided that it is properly maintained. To uphold this warranty, it is imperative to reseal the wood every six (6) months using sealants recommended by Chilo Plunges and to use the cover and lid provided to protect the structure from environmental elements.
  2. Mechanical, Plumbing, and Electrical Components: All mechanical, plumbing, and electrical components of the cold plunge are under warranty for a duration of one (1) year from the date of purchase.

Please Note: If the cold plunge is placed in direct sunlight, it is required to use the provided UV cover at all times to protect the wood and components from potential damage caused by prolonged exposure to sunlight.

WARRANTY LIMITATIONS

This Limited Warranty is subject to the following limitations and conditions:

  1. Voidance Conditions: This Limited Warranty shall be rendered void if:
    1. The Product is used/utilized in a commercial setting.
    2. Failure to follow the recommended maintenance procedures as prescribed by the Company including but not limited to the failure to reseal the wood every six (6) months.
    3. The Company or its designated representative determines that the cold plunge has undergone alteration, neglect, misuse, or abuse.
    4. Unauthorized modifications or repairs performed by individuals not authorized by Chilo Plunges or a designated representative.
    5. The failure is caused by accident, acts of God, or other causes beyond the control of the Company.
  2. Neglect, Misuse, and Abuse: Neglect, misuse, and abuse include, but are not limited to, any installation, operation, or maintenance of the cold plunge other than in accordance with the instructions contained in the owner’s manual provided with the cold plunge. This encompasses:
    1. Failure to maintain proper water chemical balance.
    2. The use of abrasive or improper cleaners or non-genuine parts and accessories.
  3. Owner's Liability: The cold plunge owner assumes liability for repair work performed by anyone other than the Company or a designated representative. The Company is not responsible for work performed on any units outside of the specified jurisdiction.

PROCESS FOR WARRANTY CLAIM

To make a warranty claim, please follow these steps:

  1. Contact our customer service department at chiloplunges@gmail.com  within the warranty period.
  2. Provide proof of purchase, including the date of purchase and the place of purchase.
  3. Describe the nature of the issue and provide any relevant details.
  4. Our customer service team will assess the claim and determine the appropriate course of action, which may include repair, replacement, or refund at our discretion.

LIMITATIONS ON IMPLIED WARRANTIES

This Limited Warranty supersedes all other warranties, express or implied, in fact or at law. All warranty service must be performed by the Company or its designated representative using authorized cold plunge parts. No agent, dealer, distributor, service company, or other party is authorized to change, modify, or extend the terms of this limited warranty in any manner whatsoever. The Company shall not be responsible for any statements or representations made in any form that go beyond, are broader than, or are inconsistent with any authorized literature or specifications furnished by the Company.

DISCLAIMERS

Chilo Plunges and its representatives shall not be responsible for incidental or consequential damages. They shall not be liable for any injury, loss, cost, or other damage, whether incidental or consequential, arising out of any defect covered by this limited warranty. This includes, without limitation, loss of use of the cold plunge, the cost for removal of the defective Product, even if the Company was advised of the possibility of damage, and water damage. The liability of the Company under this limited warranty, if any, shall not exceed the original amount paid for the defective product.

Coverage under this limited warranty shall commence as of the original date of purchase, and the duration of such coverage shall not extend for any reason beyond the stated time periods. These disclaimers shall be equally applicable to any service provided by the Company and its designated representatives.

LEGAL RIGHTS

This Limited Warranty gives you specific legal rights. There are no warranties applicable to Products except as expressly stated herein or as implied by applicable state and federal laws. You may also have other rights that vary from state to state. Some states do not allow limitations on how long an implied warranty lasts, disclaimer of certain warranties, or the exclusion or limitation of incidental or consequential damages so some of the above limitations.
